Terms of Use

1. The App

NailNote helps nail salons record customers, visits, polish colors, recipes, photos, and inventory. It is a business tool for salon owners and staff and is not intended for personal or consumer use. You must be at least 18 years old, or the age of majority where you live, to use it.

2. Your account

• Give accurate information and keep it up to date.
• Keep your password private. You are responsible for everything done with your account.
• Tell us right away at support@nailnote.app if you think someone else is using your account.

3. Salons, roles, and team members

The person who creates a salon in the App is its Owner. The Owner, and Managers where the App allows, decide who joins the salon and which role each member has (Manager, Tech, or Viewer). The Owner is responsible for who has access to the salon's data and for removing people who should no longer have it. An Owner can transfer ownership to another member; the new Owner then takes on these responsibilities.

4. Your content and your customers' data

Everything your salon enters or uploads, including customer names, phone numbers, notes, visit records, recipes, and photos ("Salon Content"), belongs to you. You give us permission to store, process, and display Salon Content only as needed to run the App for your salon, as described in the Privacy Policy.

You are responsible for Salon Content. In particular, you confirm that you have your customers' permission, and any consent the law requires, to record their information and photograph their nails, and that you will use the App in line with the privacy laws that apply to your salon.

5. NailNote Pro and Business subscriptions

• Plans. The core App is free. NailNote Pro and NailNote Business are optional paid subscriptions that add extra features and raise the Free plan's limits (currently 1 salon and 3 members per salon, owner included). Current plans, prices, limits, and features are shown in the App before you buy.
• Free trial. Each salon gets a free Pro trial (currently 30 days) that needs no payment details and ends on its own.
• Who subscribes. Only a salon Owner can subscribe. A subscription belongs to the Owner's account and covers the salons that person owns up to the plan's limit (currently 1 salon for Pro and 3 for Business), starting with the earliest created. If ownership of a salon is transferred, that salon's plan follows the new Owner.
• Billing and renewal. Payment is charged to your Apple ID (or Google Play account) when you confirm the purchase. The subscription renews automatically for the same period and price unless you cancel at least 24 hours before the end of the current period.
• Cancelling and refunds. You can manage or cancel your subscription at any time in your App Store or Google Play account settings. Cancelling stops the next renewal; Pro stays on until the end of the period you paid for. Refunds are handled by Apple or Google under their policies.
• When a plan ends or changes. A salon no longer covered returns to the free version. Salon Content and existing members are kept; Pro features are locked, and new members or salons beyond the Free limits cannot be added, until you subscribe again.
• Changes. We may change prices, plans, or which features are included in Pro. Price changes for existing subscriptions follow the App Store and Google Play rules, including advance notice.

6. Acceptable use

You agree not to:

• use the App for anything unlawful, or to store content you have no right to store;
• try to access another salon's data or any account that is not yours;
• interfere with, overload, or try to break the security of the App;
• copy, resell, or reverse engineer the App, except where the law allows it;
• upload malware, spam, or content that is abusive or infringes someone else's rights.

7. Deleting data and your account

Deleted customers, visits, recipes, and colors go to the salon's Trash and are permanently removed, photos included, after 30 days. Anything deleted permanently cannot be recovered. You can delete your account in the App (Profile → Delete Account). Deleting your account does not cancel a NailNote Pro subscription; cancel it in your store account first.

8. Changes, suspension, and termination

We keep improving NailNote and may add, change, or remove features. You may stop using the App at any time. We may suspend or close an account that breaks these Terms or puts the App or other users at risk, and we will tell you when we reasonably can.

9. Disclaimer

The App is provided "as is" and "as available". To the fullest extent the law allows, we make no warranties, express or implied, including that the App will be uninterrupted or error free. Keep your own records of anything your business cannot afford to lose.

10. Limitation of liability

To the fullest extent the law allows, DS Studio LLC is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data. Our total liability for any claim relating to the App is limited to the greater of the amount you paid us for the App in the 12 months before the claim, or US $50. Some places do not allow these limits, so they may not apply to you.

11. Apple App Store terms

If you downloaded the App from the Apple App Store:

• These Terms are between you and DS Studio LLC only, not Apple. Apple is not responsible for the App or its content.
• Your license is to use the App on Apple devices you own or control, as allowed by the App Store Terms of Service.
• Apple has no obligation to provide maintenance or support for the App.
• If the App fails to meet an applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any. Apple has no other warranty obligation for the App.
• Apple is not responsible for any claims about the App, including product liability, legal or regulatory compliance, consumer protection, or intellectual property claims; DS Studio LLC is.
• You confirm that you are not in a country subject to a U.S. Government embargo or on any U.S. Government list of prohibited or restricted parties.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

12. Governing law

These Terms are governed by the laws of the State of Tennessee, USA, without regard to its conflict of law rules. Any dispute will be resolved in the state or federal courts located in Knox County, Tennessee, unless the law where you live requires otherwise.

13. Changes to these Terms

We may update these Terms from time to time. Material changes will be reflected by the effective date above and, when appropriate, announced in the App. Continuing to use the App after a change means you accept the updated Terms.
